Software Agreement

This Software Agreement ("Agreement") governs the terms and conditions for the use of the Beauty School Boss software ("Software") provided by Beauty School Boss ("we," "us," or "our"). By accessing or using the Software, you ("User," "you," or "your") agree to be bound by the terms and conditions set forth in this Agreement.

License Grant

1.1 Subject to your compliance with the terms and conditions of this Agreement, we grant you a limited, non-exclusive, non-transferable license to use the Software for the purpose of managing and administering cosmetology, esthetics, nail, and barber school activities.

1.2 This license is granted solely for use in public high schools, private schools, and colleges that provide cosmetology, esthetics, nail, and barber education.

1.3 You agree not to:

a) Modify, adapt, translate, or create derivative works of the Software.

b) Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software.

c) Sell, lease, sublicense, distribute, or otherwise transfer or make the Software available to any third party.

d) Use the Software for any illegal, unauthorized, or improper purposes.

Ownership and Intellectual Property

2.1 The Software, including all intellectual property rights, is and shall remain the sole property of Beauty School Boss. This Agreement does not grant you any ownership rights to the Software.

2.2 You acknowledge that any suggestions, ideas, or feedback provided by you regarding the Software may be used by us without any obligation to compensate you or maintain their confidentiality.

Support and Maintenance

3.1 We will provide reasonable technical support and maintenance services for the Software during the term of this Agreement. Support may be provided through email, online chat, or other means as determined by us.

Data Security and Privacy

4.1 We implement appropriate security measures to protect your information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is entirely secure, and we cannot guarantee the absolute security of your information.

4.2 You agree to comply with all applicable data protection laws and regulations, including obtaining any necessary consents from individuals whose personal information is processed through the Software.

4.3 Beauty School Boss will not share, sell or distribute school or student data unless it is ordered by a court of law.

Term and Termination

5.1 This Agreement shall remain in effect until the school is no longer using the software and all contracts are terminated.

5.3 We may suspend or terminate your access to the Software immediately, without prior notice, if you breach any provision of this Agreement.

5.4 Upon termination of this Agreement, you shall cease all use of the Software and delete any copies of the Software in your possession or control.

Limitation of Liability

6.1 To the extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business, arising out of or in connection with the use or inability to use the Software.

6.2 In no event shall our total liability to you for all damages exceed the amount paid by you for the Software during the twelve (12) months preceding the event giving rise to the liability.

Governing Law and Dispute Resolution

7.1 This Agreement shall be governed by and construed in accordance with the laws of the United States of America.

7.2 Any dispute arising out of or in connection with this Agreement shall be resolved through good-faith negotiations between the parties. If the dispute cannot be resolved amicably, it shall be submitted to binding arbitration.

Children's Privacy

8.1 We will not collect, maintain, use or share Student PII beyond that needed for authorized educational/school purposes, or as authorized by the parent/student. We will not sell, use or disclose student information and we will never advertise to students.

Entire Agreement

10.1 This Agreement constitutes the entire agreement between you and Beauty School Boss regarding the use of the Software and supersedes all prior agreements and understandings, whether written or oral.

By using the Beauty School Boss software, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this Software Agreement. If you do not agree with these terms, you should not use the Software.

License to Use the Service

Payment and Refund Policy

2.1 Payment:

a) You agree to pay all applicable fees associated with your use of the Service as specified in the pricing plans or invoices provided to you. Payment must be received before software access is granted.

b) Payment shall be made in the currency specified by us.

2.2 Refund Policy:

a) Annual Subscription: Students who are enrolled in the annual subscription plan are eligible for a 30-day money back guarantee. The 30-day period begins on the first day of school. To request a refund, you must provide proof of enrollment and submit your request within the designated 30-day period. After the 30-day period, no refunds will be issued for the annual subscription plan.

b) Monthly Subscription: Students who are paying on a monthly basis are not eligible for a refund.

User Obligations and Restrictions

3.1 You agree to:

a) Provide accurate and complete information when registering for an account and using the Service.

b) Use the Service in compliance with applicable laws, regulations, and this Agreement.

c) Keep your account credentials confidential and not share them with any third party.

d) Be solely responsible for your use of the Service, including any content you upload, transmit, or otherwise make available through the Service.

3.2 You agree not to:

a) Use the Service for any illegal, unauthorized, or improper purposes.

Termination

4.1 We reserve the right to suspend or terminate your access to the Service at any time, due to non payment.

4.2 Upon termination, you shall immediately cease all use of the Service and delete any copies of the Service in your possession or control.

Limitation of Liability

5.1 To the extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business, arising out of or in connection with your use of the Service.
